FSSAI Food Product/ Food Ingredient Approval
If FBO is involved/dealing in food product or ingredients thereof or new product formulation which is not covered under FSS (Food product standards and Food Additives) regulation, 2011 (part I & II), OR Product/Ingredient is new to Indian Market, then FBO must obtain Food Product Approval for such products /ingredients thereof before applying for central license as per FSS Nutraceutical Rules, 24 Nov 2016.
No FBO can import, manufacture, handle or sale such food product/ingredient without obtaining required NOC or Food Product Approval for product NOT listed in FSS (Food product standards and Food Additives) regulation, 2011 (part I & II).
After obtaining NOC for product/ingredient FBO must submit required safety evaluation data for obtaining Product Approval for Novel Food Composition or Novel Food Ingredient/Food Additive.
FBO can only apply for FSSAI Lisence after obtaining required product approval.

FSSAI Compliance- Schedule 4 and Form D1:
FSS Rules, 2011 has laid down GMP requirements under Schedule 4 must be followed and implemented by all FBO (Food Business Operators) irrespective of holding valid FSSAI license. e.g. Change Room Facilities, Hygiene Station, Hand Washing Facility, Construction Design (Wall, Floor, Door, Roof), Water Quality, Basic Hygiene facility required to product safe food etc.

FSSAI Annual Return Form D-1 & Form D-2
- Every licensee shall on or before 31st May of each year, submit a return electronically or in physical form as may be prescribed by the concerned Food Safety Commissioner, in ‘Form D-1’ provided in Schedule 2 of these Regulations to the Licensing Authority in respect of each class of food products handled by him during the previous financial year.
Provided however that every licensee engaged in manufacturing of milk and/or milk products shall file half yearly returns for the periods 1st April to 30th September and 1st October to 31st March of every financial year in the form D-2, as provided in Schedule-2 of these regulations. Such returns will be filed within a month from the end of the period. - A separate return shall be filed for every license issued under the Regulations, irrespective of whether the same Food Business Operator holds more than one license.
- Any delay in filing return beyond 31st May of each year shall attract a penalty of Rs 100 per day of delay.
